Construction Defects Lawyer in Israel
Attorney & Engineer Yossi Meshulam
Attorney Yossi Meshulam represents apartment buyers, homeowners and condominium representatives in disputes involving construction defects, water intrusion, defective workmanship and claims against developers and contractors in Israel.
Yossi Meshulam has practiced law in Israel since 1997 and is also a qualified mechanical engineer. His engineering background assists him in understanding technical reports, expert opinions and the engineering issues that frequently arise in construction defect litigation.
Construction defects in a new apartment
Defects in a newly built apartment may include water penetration, waterproofing failures, plumbing problems, cracks, defective flooring or cladding, window and aluminum defects, safety issues and defects in the common property.
Under the Israeli Sale (Apartments) Law, the seller of a new apartment may be responsible for defects discovered after delivery of the apartment.
The applicable liability period and burden of proof depend on the type of defect and the time at which it was discovered.
Inspection and expert opinion
In many cases, the first step is a professional inspection of the apartment.
An appropriate expert can identify and document the defects, investigate their cause, recommend a repair method and estimate the reasonable cost of repair.
Where the defect cannot be fully repaired and causes permanent loss of value, a real estate appraiser may also be required.
Giving the seller an opportunity to repair
Israeli law generally requires the buyer to provide the seller with an adequate opportunity to repair a defect that can be repaired.
This does not give the seller an unlimited right to make repeated unsuccessful repair attempts.
Where the defect recurs, repairs fail, the seller delays unreasonably or denies the existence of the defect, it may be necessary to consider whether the opportunity to repair has already been exhausted.
Water damage and moisture problems
Water intrusion disputes frequently require both legal and technical analysis.
A visible stain does not necessarily identify the source of the water. Moisture may originate in plumbing, waterproofing, a roof, an exterior wall, a balcony, another apartment or the common property.
Identifying the source before assigning legal responsibility is therefore essential.
Construction defect litigation
When the dispute cannot be resolved directly with the seller or contractor, legal proceedings may be considered.
Depending on the circumstances, a claim may seek the cost of repairs, an order requiring repairs, compensation for loss of value, consequential damages and other remedies available under Israeli law.
Courts frequently rely on expert evidence and may appoint an independent expert to examine the property and the parties' technical claims.
Delayed delivery of a new apartment
A buyer may also have a statutory claim where a new apartment is delivered after the contractual delivery date.
The compensation rules depend, among other matters, on the date on which the sale agreement was signed. Israeli law was materially amended on July 7, 2022.
Legal and engineering perspective
Construction defect cases often involve questions that are both legal and technical.
The dispute may concern the actual cause of water penetration, whether a proposed repair method is adequate, whether workmanship complies with the contractual specification or applicable standards, and what constitutes a reasonable repair cost.
Yossi Meshulam's combined legal practice and engineering background enables the technical issues to be considered as part of the legal strategy rather than as a separate matter.
